A man from Buncrana has been sent to prison for five months for fracturing the eye socket of a man in an assault in Derry in 2010.
26-year-old Damian Hugh Hegarty of 52, Bearwood in Buncrana admitted the charge of unlawfully inflicting grievous bodily on a man on February 21 2010.
The court was told that Hegarty had been out of the jurisdiction but had handed himself in to have the charge dealt with.
Derry Magistrate’s Court heard that Hegarty called at the address of the injured party.
The man opened the door and Hegarty punched him in the face causing him to fall to the ground Hegarty then tried to kick him.
When he was arrested he made admissions.
A defence barrister Mr. Eoin Devlin said that the incident stemmed from ‘a perceived slight and jealousy.’
He said that prior to the incident there was no animosity between the pair who were not known to each other.
He described the incident as ‘nasty but isolated’ and said Hegarty had come to have it dealt with.
District Judge Barney McElholm said that it was ‘an unprovoked attack on someone in their own house.’
He sentenced Hegarty to five months in prison.
