Development Plan to be changed following High Court ruling


The Donegal County Development Plan will be varied in the new year to take into account a settlement reached with Planree Ltd in the High Court.
It’s after Planree challenged elements of the plan earlier this year.

Donegal County Council has published a notice confirming the deletion of elements of the County Development Plan Following a High court case taken against the authority by Planree Limited.
The proceedings, which related to development guidelines pertaining to wind farms, were not opposed by the council on foot of discussions at the September meeting.
Following discussions at the High Court, an order was signed on the fifth of this month confirming the settlement. The court order directs that two clauses be removed from the Wind Energy guidelines, as well as a related map from the document.
A note to that effect has now been published on the council’s website, and CEO Seamus Neely says staff will begin preparing a formal variation in the new year.
The November 5th order also grants costs to Planree Ltd.
Cllr Patrick Mc Gowan, who proposed beginning the variation as quickly as possible, says the variation must reinsert provisions governing wind energy which reflect the wishes of members, while also taking into account the outcome of the High Court proceedings.
