The driver the Clonmany crash in which eight people where killed has been sent forward for trial to Letterkenny Circuit Court on May 1st.
Shaun Kelly, 23, from Hillroad, Ballymagan, Buncrana, had been charged with causing the death of the seven passengers travelling in his car and another man, Hugh Friel on 11th July 2010.
Accompanied in court by his mother Pauline, and dressed in black, Kelly nodded when told by Judge Paul Kelly he would be sent for trial.
Defence solicitor Ciaran MacLochlainn asked Judge Paul Kelly to amend the charge sheet as there had been a “grammatical” issue with it.
After consultation with the state prosecutor Ciaran Liddy, Judge Kelly agreed to the small amendment.
On the previous occasion Mr Mc Lochlainn required two exhibits from the book of evidence, including a video of the scene of the accident and original photographs.
Speaking in Buncrana court this afternoon Mr. MacLochlainn said he had received the exhibits and had a chance to examine them.
HE added: “Apart from the small amendment we have no other issues.”
Inspector David Murphy from Buncrana Garda Station said after advising with the DPP it was agreed that Kelly should be sent forward to the next criminal sitting of Letterkenny Circuit Court.
He was released on a continuing bail bond under his mother’s supervision, which both parties signed in court.
