A Letterkenny solicitor is seeking to bring a High Court challenge to the co-option of a councillor to Donegal County Council.
He claims the post should have been filled by a non-party candidate, Labour insist that Councillor McBride was not a member of the party at the time of his co-option.
Desmond Sheils, an unsuccessful Independent candidate in the last local elections, claims Michael McBride was co-opted on May 30th as Labour Party representative to replace Jimmy Harte, elected to the Seanad in April.
