The legality of the co-option by Labour of Councillor Michael McBride on to Donegal County Council has been called in to question.
While stating he has no issues with the personalities involved, Letterkenny Solicitor Dessie Sheils has quoted council legislation which deems the co-option against the rules.
Councillor McBride replaced now Senator Jimmy Harte on the council, but Senator Harte was elected as an independent with legislation suggesting he must be replaced be a non-party person.
